A recent federal appeals court ruling in Davis v. Ill. Dep’t of Hum. Servs. has clarified that an employee’s FMLA leave entitlement isn’t strictly limited by the exact wording of their medical certification. The court found that an employer should have recognized a pregnant employee’s FMLA-qualifying morning sickness, despite the certification stating no “episodic flare-ups.” This case emphasizes that employers must consider all available information when managing leave, rather than rigidly adhering to certification details, especially with the added protections of the Pregnant Workers Fairness Act.
