A recent Sixth Circuit court case, Simon v. University Hospitals, clarified that employers can’t solely rely on limited doctor’s paperwork to determine an employee’s disability status under the ADA. Employers must consider all asserted limitations on major life activities beyond just “working” and avoid policies that prohibit job reassignments or tolerate gossip about an employee’s condition.
